Manndown provides a platform to connect customers who request on-demand roadside and assistance services with drivers/service providers who offer such services. Manndown is not a transportation or towing company; we operate solely as a technology platform to facilitate these connections.

2. Eligibility

You must:

• Be at least 18 years old.
• Have legal capacity to enter into a binding agreement.
• For drivers/service providers: hold all required licenses, permits, insurance, and certifications for your services.

3. Accounts

3.1 Registration

To use the Services, you must register for an account and provide accurate, complete information.

3.2 Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Payments and Payouts

4.1 Stripe Connect

We use Stripe Connect to process payments and payouts. By using our Services, you agree to be bound by the Stripe Connected Account Agreement and Stripe Privacy Policy.

• Customers authorize payment for services through Stripe.
• Drivers authorize payouts through Stripe.

4.2 Pricing

Service fees, commissions, and pricing are displayed in the app before booking.

4.3 Taxes

Drivers are responsible for all applicable taxes related to their earnings. We may issue IRS Form 1099 or equivalent where required.

5. User Responsibilities

You agree to:

• Use the Services only for lawful purposes.
• Not interfere with or disrupt the Services.
• Provide accurate and up-to-date information.
• For drivers: maintain safe, reliable equipment and comply with all applicable laws.

6. Cancellations and Refunds

• Customers may cancel service requests according to the app’s cancellation policy.
• Refunds, if applicable, are processed according to our refund guidelines.

7. Prohibited Conduct

You may not:

• Engage in fraud, misrepresentation, or illegal activity.
• Harass, abuse, or harm other users.
• Attempt to access non-public areas of our Services.

8. Safety and Liability

• We do not guarantee the quality, safety, or legality of services provided by drivers.
• We are not liable for damage, injury, or loss resulting from services booked through the platform.
• Users are encouraged to report incidents through the in-app support system.

9. Account Termination

We may suspend or terminate your account if you violate these Terms, our Privacy Policy, or applicable laws.

10. Data Retention

We may retain certain information after account deletion for legal and regulatory purposes, including tax reporting and dispute resolution.

11. Disclaimer of Warranties

Our Services are provided “as is” and “as available” without warranties of any kind.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Manndown and its affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

17. Payment Information

Saving Your Payment Method

By selecting “Save my payment method for future rides” at checkout, you authorize [Your Company Name] (“we,” “our,” “us”) to store a tokenized reference to your payment method with our payment processor, Stripe, for your convenience. Stripe securely stores your payment details in compliance with PCI-DSS standards; we only retain a reference ID and do not store your full card number.

Future Charges

You authorize us to initiate charges to the saved payment method for:

• Rides or services you request through the Manndown app.
• Adjustments related to those rides (for example, tolls, tips, or cancellation fees).

Timing & Frequency

Charges will be initiated at the time a ride is completed or, if applicable, when a cancellation fee or adjustment is due. Charges occur on a per-ride basis and may vary depending on the distance, duration, and pricing factors displayed to you in the app.

Amount Determination

The amount charged will be based on the price calculated and displayed to you before or during the ride request, including applicable taxes, fees, tolls, or tips you select.

Revoking Consent

You may revoke this authorization at any time by removing your saved payment method from the app. Removal will prevent future charges to that payment method but will not affect any charges already incurred.
